These BestModelAI Terms of Service (the “Terms”) are an agreement between you and ImageCraft L.L.C. Affiliates (collectively, “BestModelAI”, “we”, “us”, or “our”) regarding your use of the BestModelAI Services (“BestModelAI”). As used in the Terms, “you” refers to both you personally and the entity you represent. By using BestModelAI, you agree to these BestModelAI Terms of Service.

BestModelAI’s BestModelAI Platform Terms of Service also apply to your use of BestModelAI. In the event of a conflict between the BestModelAI Platform Terms of Service and these BestModelAI Terms of Service, these BestModelAI Terms of Service will control. If you purchase a subscription to BestModelAI, the Subscriber Terms will also apply. For purposes of the BestModelAI Platform Terms of Service, BestModelAI is part of the “BestModelAI Platform”. Capitalized terms used but not defined in these BestModelAI Terms of Service have the same meaning as those set forth in the BestModelAI Platform Terms of Service.

IMPORTANT ARBITRATION NOTICE: IF YOU ARE LOCATED IN THE UNITED STATES OR CANADA, YOU AGREE THAT DISPUTES BETWEEN YOU AND BestModelAI WILL BE DECIDED BY BINDING, INDIVIDUAL ARBITRATION AND WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION OR CLASS ARBITRATION. FOR A DESCRIPTION OF THE PROCEDURE, CERTAIN EXCEPTIONS, AND HOW TO OPT OUT OF ARBITRATION, PLEASE SEE SECTION 10 OF THE BestModelAI PLATFORM TERMS OF SERVICE.

1. OPEN EXPLORATION PLATFORM (BestModelAI).

BestModelAI is a large platform that allows you to explore and interact with a wide variety of bots powered by third-party Large Language Model (LLM) enterprises and repositories such as OpenAI and Anthropic. BestModelAI diplomacy allows you to create your own bots based on such third-party LLMs. You may use bots for a variety of purposes, such as learning, writing assistance, translation, programming assistance, summarization, entertainment, etc. The bot profile contains a description of the bot and the name of the company, bot, or individual who created the bot. See Settings to find usage guides for all bots. BestModelAI is a large platform that provides access to a wide variety of third-party bots, but does not provide and is not responsible for the content or services provided by such bots.

2. AGE REQUIREMENT.

No one under the age of 13 may use BestModelAI. You represent that you are of the age of majority in your neighborhood. If not, your parent or guardian must agree to these BestModelAI Terms of Service and confirm that they accept these Terms on your behalf and are responsible for your use. Bots on BestModelAI may generate content that is not suitable for independent readers. By accepting these BestModelAI Terms of Service on behalf of another person or entity, you confirm that you have the legal authority to bind that person or entity to these Terms.

3. Have fun using BestModelAI.

3.1. Use of BestModelAI. Subject to your compliance with these Terms, we grant you a personal, non-exclusive, non-transferable right to use BestModelAI and its bots.

3.2. User Acknowledgement. You acknowledge and agree that:

It is not advisable to over-rely on bots on BestModelAI in an emergency; bots may claim to perform an action for you but actually take no action other than responding to you; Bots on BestModelAI may generate inaccurate information or provide outdated information. You should independently verify the responses or suggestions provided by any bot on BestModelAI. BestModelAI makes no warranties or guarantees as to the accuracy of the information provided through BestModelAI; BestModelAI and the robots on it may be revised or modified and may contain errors, design defects or other problems; Using the robots on BestModelAI may cause unexpected results, loss of data or communications, or other expected or unexpected damages or losses to you; The robots on BestModelAI may not operate properly, reach their final form or have incomplete functionality; We do not guarantee your access to BestModelAI or the robots, and BestModelAI and the robots are provided "as is"; 3.3. Limited Use. You agree not to use BestModelAI or Robots to:

Infringe the rights of others or violate any applicable laws; Violate these Terms or our policies, or the relevant policies of other third parties that support Robots on BestModelAI (see the relevant Robot introduction or access; Decompile, reverse compile, decompile, translate or otherwise attempt to explore the source code components of models other than the foundation, algorithms, BestModelAI systems, robots, and other underlying technologies; Cheat, damage, interfere with, reverse engineer or destroy BestModelAI, robots, and other underlying technologies, such as accessing or using them in a deceptive or fraudulent manner, introducing malware, sending spam, hacking or bypassing any protection measures; Use BestModelAI or Robots in an automated manner, such as exceeding any rate drift set by us from time to time; Use BestModelAI or Robots to develop products, applications, services, foundation models or other large-scale models that compete with BestModelAI, Robots and their underlying technologies; Use any method (such as allowing web scraping, network collection or web extraction of data) to extract data from BestModelAI or Robots, but the consequences of these BestModelAI Terms of Service; or Robots claim that the generated content (as defined below) is human-generated. 3.4. Feedback. We welcome your feedback and suggestions on how to improve BestModelAI instead of using robots. By submitting feedback, you grant us the right to freely use, reproduce, disclose, create derivative works from, display, publish, or otherwise use your feedback, in whole or in part, at our discretion, without compensation to you. 4. Your Content.

4.1. Your Content. BestModelAI may allow you to ask questions, bookmark, vote or like, post, or share robot conversations within or outside of BestModelAI. All materials you upload, post, or display within BestModelAI, and any results you receive from robots on BestModelAI based on your prompt words (or other input) (collectively, "Robot-Generated Content"), will be collectively considered "Your Content".

Other users may ask similar or identical questions to you on BestModelAI and receive responses from robots. Content received by other users is not considered Your Content.

4.2. Your Robot. BestModelAI may allow you to create robots powered by third-party method masters or share robots on BestModelAI. Add your own bot to the Platform for users to interact with (i.e., "Your Bot"). Your Bot will be associated with your BestModelAI Personal Data Name. You are not obligated to create a bot, but if you choose to create one, you should ensure that its content is legal and does not violate these Terms, our policies, or the policies of other third-party LLMs that provide content to your bot. If your bot violates these Terms, our policies, or the policies of other third-party LLMs that provide content to your bot, or applicable law, BestModelAI may remove your bot at its sole discretion. BestModelAI is not responsible for any content of your bot or the use of your bot by others. If you choose to use our API to contact your bot, the BestModelAI API Terms apply to your use of such API. If you choose to participate in the Creator Earnings Program, the Program Terms apply to your participation in the Program.

4.3. The content of Your Content belongs to you, subject to the non-excludable rights granted below.

4.4. Your Responsibilities. You acknowledge and agree that the bots on BestModelAI answer your questions based on knowledge obtained from multiple sources, and that BestModelAI does not create or generate any bot-generated content. BestModelAI supports access to a variety of underlying technologies, including third-party LLMs that lay the foundation. LLMs are machine learning systems that can process and generate text. You agree that you are solely responsible for your content and your bots, including ensuring that they do not violate any applicable laws, these Terms (including the restricted uses set forth in Section 3.3 above), our policies, or the policies of others that support any third-party LLMs that power bots on BestModelAI.

We have the right to block, delete, and/or permanently remove your content or your bots if they violate these Terms, our policies, or the policies of others that support any third-party LLMs that power bots on BestModelAI, or any applicable laws or regulations, or create risks for BestModelAI or BestModelAI or negatively impact the experience of other BestModelAI users.

4.5. We may use Your Content and Your Bot to provide and improve BestModelAI, including: Providing your questions and prompt words to third-party LLMs to generate responses Displaying Your Content to others (if you use BestModelAI's sharing feature

Within BestModelAI, Your Bot will be available for others to use and interact with Promote your shared content or your Bot to others Understand your use of BestModelAI to improve BestModelAI as a whole We may also need to use or disclose Your Content to comply with applicable laws, enforce these BestModelAI Terms of Service and our policies, and detect and prevent any fraud, security or technical issues.

By using BestModelAI, you grant us a worldwide, non-exclusive, royalty-free, transferable, perpetual license to use Your Content and Your Bot as described above.

5. Refund Policy.

We have established different refund policies based on subscription type, topping up type,regional laws, and account status.

After you submit your refund request, we will manually review your order and send the review results or request additional information via the email you provided within 48 hours. Please be sure to check your email, including your spam folder, to avoid missing any important emails. Please follow the instructions in the email carefully.

If you fail to complete the next steps within the timeframe specified in the email, we will be unable to process your refund. We reserve the final right of interpretation for all refund-related matters.

EU or Turkey customers:

If you reside in the EU or Turkey, you are eligible to cancel your subscription and receive a refund within 14 days of purchase, applicable to both monthly and annual subscriptions. Please specify in your refund request that you are applying for a refund under EU or Turkey regulations.

If there are any irregularities with your account, our customer service may require you to provide relevant proof when processing the refund request.

All other customers:

Although we strictly adhere to our policies, we may not be able to fulfill your refund request if there are irregularities with your account. We strive to make our refund policy as fair as possible.

Monthly and Weekly subscriptions: You can apply for a refund within 24 hours of the purchase charge. Please state the reason for your refund request in your application.

Annual subscriptions: You may apply for a full refund within 72 hours of the initial purchase charge date and time. No refunds will be granted for requests made after this period.

Topping Up:

Topping up is a special kind of service and is therefore non-refundable once purchased.

According to our terms of service, unused advanced credits from the Topping Up package remain valid from the date of purchase and can be used while the membership subscription is active. However, once purchased, the amount paid will not be refunded.

Please note that if you have previously received a refund for our services, we reserve the right to deny subsequent refund requests. This policy is designed to prevent abuse of our refund system and ensure fair use of our services.

While we are inclined to offer full refunds within the eligible period, we reserve the right to determine the refund amount based on your actual usage of the product. This is to prevent malicious behavior where users may consume excessive service before applying for a refund.

6. Termination.

You may terminate your use of BestModelAI or these BestModelAI Terms of Service at any time, for any reason or no reason, by deleting your account in Settings. We may terminate your access to BestModelAI and/or these BestModelAI Terms of Service at any time, for any reason or no reason. Any data collected prior to termination may continue to be used in accordance with these Terms. In addition to Section 11(e) of the BestModelAI Platform Terms of Service, the following provisions will also survive termination: Section 3.4 (Feedback), Section 4.3, 4.4 and 4.5 (Your Content), Section 5 (Restrictions), Section 7 (Disclaimer and Liability) and Section 8 (General Terms).

7. Privacy.

As mentioned in the BestModelAI Privacy Policy, we may collect certain personal information (such as contact information, etc.) related to your use of BestModelAI. Your account information will be shared with third-party methodological masters and charities after being anonymized. Third-party arms and LLMs are most likely to receive photos and details of your interactions with robots on BestModelAI (such as chat content, likes, etc.) to provide responses and improve the overall service. You do not need to provide sensitive personal information (such as credit card information, social security information, etc.) to the robot. 8. Disclaimer and Limitation of Liability

Section 8 of the BestModelAI Platform Terms of Service is incorporated herein by reference, except that Section 8(e) of the BestModelAI Platform Terms of Service is replaced by the following: Without limiting the foregoing, BestModelAI's maximum liability to you for any loss or damag

arising out of or in connection with your use of the BestModelAI Services or these Terms and Conditions shall be limited to the amount you have paid to BestModelAI in the preceding twelve (12) months for the BestModelAI Services giving rise to the allegation.

We cannot guarantee the availability of any Robot, feature or service offered by or through BestModelAI. We are continually developing new features, adding Robots and improving BestModelAI, but we may add or remove features or Robots, or limit their use or availability entirely (or only in certain places or to certain users), without notice to you, if such features or Robots create risks for BestModelAI, BestModelAI's users, other third parties that support the Robots, or are no longer commercially viable, or for any reason (as determined by us in our sole discretion). We also cannot guarantee that your use of BestModelAI will be error-free, uninterrupted or without service interruptions. We are not responsible for any errors, interruptions or service interruptions that may occur.

9. General Terms.

You agree that any claim not covered by Section 10 of the BestModelAI Platform Terms of Service shall be resolved in a court of competent jurisdiction in Boulder, Colorado, USA, and that the terms of this Section and any claim shall be governed by the substantive laws of Boulder, Colorado, USA (without regard to conflict of law rules). These Terms shall be binding upon and inure to the benefit of you and our heirs, successors and/or assigns.
